Intent

The provisions of this policy are intended as guidelines and are not meant to be exhaustive. Generally, conduct that violates law, regulation or the accepted norms of the Internet community, whether or not expressly mentioned in this policy, is prohibited. We reserve the right at all times to prohibit activities that damage our commercial reputation and goodwill.

Ordering our services and accessing your account is deemed acceptance of these Terms & Conditions. Please note that Hostingireland may terminate your account without notice for any breach of these Terms.

Security

Any "denial of service" attack, any attempt to breach authentication or security measures, or any unauthorized attempt to gain access to any other account, host or network is prohibited, and will result in immediate services termination, which may be without notice.

Bandwidth

if your bandwidth either exceeds the allowance set as part of your package/service or reaches the point where it has an adverse effect on other customers we reserve the right to:

• 1. disable your site, without prior notice, until you can reduce your bandwidth usage; or
• 2.charge you for excess bandwidth usage, over and above your package allowance.

Illegal or Litigious Content Policy.

Any form of illegal, potentially libellous or defamatory content or activity including, but not limited to the following will result in immediate suspension of service and possible termination of service:

• The unauthorised distribution, or copying, of copyrighted software;
• Adult Content;
• Harassment;
• Fraud;
• Trafficking in obscene material;
• Trafficking in illegal substances.

We do not host:

• Web sites with Adult content of any description;
• Web sites portraying gratuitous violence of any description;
• Web sites containing or promoting extreme political material;
• Web sites containing any religious material or supporting any religion;
• Web sites containing any occult material;
• Web sites relating to Hacking, Cracking, Warez, IRC or similar;

Downloads and Streaming

• Software downloads may only be hosted if the website owner is the writer and copyright owner of the software - this would need to be verified before being made accessible on the site;
• All other software including freeware, shareware and trial software is forbidden;
• Audio, video, MP3 and other downloads may only be hosted if the website owner is the writer, creator and copyright owner of the work.

Bulk Email

The use of our network to send bulk email, and the use of bulk email to promote a site on our network is strictly forbidden.

Misuse of Resources.

Applications that we do not allow on our network include, but are not limited to, are:

• Applications that consume excessive CPU time, memory or storage space;
• Chat/IRC, web proxy and mailing list scripts under any circumstances;
• Streaming media as it can be a drain on web server resources;
• CGI based message forums which use flat file databases;
• PHP/ASP message forums are permitted.

If you are unsure whether the content you intend to place on our network is acceptable, please check with us before you add it. We reserve the right to determine what constitutes acceptable use.

Modification.

We reserve the right to add, delete or modify any provision of this policy at any time without notice.

Your Obligation.

You undertake that you will use our services for lawful purposes and only as authorised herein. In particular that you will:

• 1. keep secure and not disclose any password which may be given to you by us to third parties and that any such password will only be used for the authorised purpose communicated to you by us and further that you will notify us immediately of any known or suspected unauthorised use of the password. You will be liable for any unauthorised use of your password;
• 2. not post, link or transmit to any of our servers any material which is unlawful, abusive, malicious, threatening, defamatory, obscene, pornographic, blasphemous or otherwise objectionable in any way;
• 3. not post, link or transmit to any of our servers any material which contains a virus or other hostile computer program or run any applications that could lead to a modification of the physical or logical structure of the networks being used;
• 4. not post, link or transmit to any of our servers any material which constitutes or encourages the commission of a criminal offence or which infringes any patent, trade mark, design or database rights, copyright or any other intellectual property right or similar rights of any persons;
• 5. adhere to laws for the protection of minors;
• 6. respect the privacy of others and that you will not send unsolicited, harassing, slanderous or threatening content;
• 7. not use any names, documents, pictures or other elements of our site so as to create the impression of any relationship whatsoever with any of our products or services, or of support for any of our products or services without our prior written consent;
• 8. not develop or attempt to develop programs designed to bypass the user interface to access our program functions;
• 9. when dealing with members of our staff, agents or representatives, not act or speak in an abusive, malicious, or offensive manner or make spurious or vexatious complaints or claims.
