These terms and conditions relate to all services provided by Hosting Ireland the trading name of Protocol Internet Technology Limited.

"Hosting Ireland" refers to the vendor and provider of hosting services.

"The Applicant" refers to: The person or company applying for hosting services.

Hosting Ireland shall provide services to The Applicant under the Terms and conditions as set out below :

This Agreement is intended to protect both the integrity and liability of Hosting Ireland and The Applicant. This Agreement will be enforced to ensure the performance, and reliability of our services. The Applicant agrees that the service is provided as per the published data and that Hosting Ireland assumes no responsibility for the timing, deletion, delivery or failure to store any customer communications or personalization settings over and above those permitted under these terms and condition or agreed in writing at the time of contract.

Hosting Services.

• Domain Registration: Please see the domain name terms and conditions. Domain registrations are final and cannot be refunded.
• Disk Space:Accounts with Hosting Ireland Services include a specific disc space allocation. Additional disk space is available. Payment for hosting is for one year in advance.
• IP Address:Accounts with Hosting Ireland do not include separate IP addresses. Separate IP addresses are available at extra cost.
• MySQL Databases: MySQL Database facilities are included in the professional hosting plans, but not the budget plans. Additional MySQL databases are available.
• Pricing: All Hosting Ireland prices are in Euro unless specified otherwise. Hosting Ireland offers a 30-day money back guarantee for hosting services.
• Payment:
  • Invoices are normally issued by email;
  • Payment is due immediately on receipt of invoice;
  • Online Payment by Credit Card is preferred;
  • A rejected payment will incur a €5 resubmission charge;
  • Inaccurate payments will incur a €5 resubmission charge;
  • Non-Irish Bank drafts that are not drawn on an associating Irish bank will incur a €5 resubmission charge.

Unlawful or Prohibited Usage:

• The Applicant will not use the Hosting Ireland services for any purpose that is unlawful or prohibited by these terms, conditions, and notices.
• The Applicant may not attempt to gain unauthorized access to any Hosting Ireland services, other accounts, computer systems or networks connected to any Hosting Ireland services through hacking, password mining or any other means.
• The Applicant may not obtain, or attempt to obtain, any materials or information through any means not intentionally made available through the Hosting Ireland services.
• Hosting Ireland reserves the right at all times to disclose any information as Hosting Ireland deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, at Hosting Ireland's services sole discretion.

Third Party

Any dealings with third parties (including advertisers) included within the Hosting Ireland services or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between The Applicant and the advertiser or other third party. Hosting Ireland shall not be responsible or liable for any part of any such dealings or promotions.

Termination:

The Applicant agrees that Hosting Ireland, at its sole discretion, may terminate The Applicant’s password, account part or use of the Service, and remove and discard any content within the Service if The Applicant violates any portion of these terms and conditions.

The Applicant’s Responsibilities:

The Applicant is solely responsible for the content of The Applicant messages whether on site or on email.

The Applicant:

• Must agree to provide true, accurate, current and complete information on the registration form
• Must agree to maintain and promptly inform us to update the Registration Data to keep it true, accurate, current and complete. If The Applicant provides any information that is untrue, inaccurate, not current or incomplete (or Hosting Ireland has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete) Hosting Ireland has the right to suspend or terminate The Applicant’s account and refuse any and all current or future use of the service (or any portion thereof).
• Must not use the Hosting Ireland services in connection with surveys, contests, pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages whether commercial or otherwise.
• Is responsible for maintaining the confidentiality of any password and account data.
• Is fully responsible for all activities that occur under The Applicant‘s password or account. The Applicant agrees to notify Hosting Ireland immediately if there is any unauthorized use of The Applicant’s password or account or any other breach of security
• Must ensure that The Applicant account is logged-out properly at the end of each session. Note: Hosting Ireland cannot and will not be liable for any loss or damage arising from The Applicant’s failure to comply with these requirements
• Who is in violation of system or network security is subject to criminal and civil liability, as well as immediate account termination. This might include, but not be limited to the following:
• Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic.
• Interference with service to any user, host or network including, without limitation.
• E-mail bombing, flooding (deliberate attempts to overload a system) and broadcast attacks.
• Forging of any TCP/IP packet header or any part of the header information in an e-mail or newsgroup posting.
• Agrees not to use his account to publish any information, software or other content which violates or infringes upon the rights of any other or which knowingly contravenes the laws of any jurisdiction in which such content is generally accessible.
• Acknowledges that Hosting Ireland does NOT permit sites that provide any content, points of distribution, or 'links' to other sites that:
  • Infringe on any third party's intellectual property or proprietary rights, or rights of publicity or privacy;
  • Violate any law, statute, ordinance or regulation under Irish Law;
  • Are defamatory, trade libellous, threatening, unlawfully harassing, abusive, pornographic or obscene;
  • Contain viruses, Trojan horses, worms, time bombs, cancel bots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another;
  • Contain Pirated or Hacking / Phreaking Software (Warez)- Any software that is copyrighted and not freely available for distribution without cost. ROMs, ROM Emulators and Mpeg Layer 3 files (MP3) all fall under this jurisdiction;
  • Has Adult Sites (content). Meaning: Any erotic or pornographic material, links to Adult sites, or advertisements for Adult sites.
• Agrees that Hosting Ireland alone have the right to determine whether any of the messages The Applicant sends are spam. Spamming generally includes, but is not limited to:
  • The bulk sending of unsolicited messages;
  • The sending of unsolicited e-mails which provoke complaints from recipients
  • The sending of junk mail
  • The use of distribution lists that include people who have not given specific permission to be included in such distribution process
  • Posting commercial ads to USENET newsgroups that do not permit it
  • Posting articles containing binary encoded data to a non-binary newsgroups
  • Excessive and repeated posting off-topic messages to newsgroups
  • Excessive and repeated cross-posting
  • E-mail harassment of another Internet Customer or Customers, including but not limited to, transmitting any threatening, libellous or obscene material, or material of any nature which could be deemed to be offensive
  • The e-mailing of age-inappropriate communications or content to anyone under the age of 18.

Hosting Ireland reserve the right to utilise the services of ‘conformity regulators’ to monitor emails. The electronic monitoring of such is carried out in an endeavour to filter emails to ensure compliance with appropriate direct marketing regulations (for example "Privacy and Electronic Communications" Directive, 2002). Such monitoring can assist in reducing the volume of spam and/or unsolicited emails being sent, for example, after instructions are given to unsubscribe from newsletters…

Copyrighted material must not be placed on The Applicant’s account without the permission of the owner(s) or person(s) they specific authorization. Only the owner(s) or person(s) authorized by the owner(s) may upload copyrighted material to the account. Upon our receipt of notice of a claimed copyright infringement, and after confirmation, we will promptly remove the allegedly infringing material and carry out further procedures if necessary. Hosting Ireland will have no liability to The Applicant for the removal of any such material.

Renewal

• Hosting Ireland will notify customer 1 month before renewal by in writing (electronic e-mail message being regarded as writing for this purpose).
• The Terms and Conditions in force at the time of renewal will then apply
• The Applicant will be informed of any major changes in the Terms and Conditions
• Copies of the Terms and Conditions will be provided by Hosting Ireland on request.
• Failure to pay renewal fee before the expiry date will result in the hosting account being suspended.
